Recent Developments in Self-Government in Spain

Governmental Changes in Galicia and the Basque Country

 

New Galician Government

 
 

Regional elections took place last 1st of March and brought about a governmental change. The governmental coalition in office since 2005, the Galician Socialists (PSdeG) and the Galician Nationalist Block (BNG), lost for just one seat their overall majority in the 75-seats parliament and, therefore, its chances for renewing their governmental position. The since then opposition party, the Conservatives (PP), which had been in office between 1989 and 2005, managed to get the minimum necessary seats (38) to create a majority single-party government.

Following the electoral defeat, both the premier (Socialist) and the deputy premier (BNG) of the 2005-2009 government resigned from their leadership posts in their respective parties.

New Basque Government

 

A post-electoral pact in the Basque Country has brought an end to 29 years of nationalist governments headed by the Basque Nationalist Party (PNB) and has made Patxi López, the leader of the Basque Socialists (PSE-EE), into the first non-basque nationalist president of the region's government. The pact was signed by the PSE-EE and the Conservative Party (PP), two parties whose differences are almost irreconcilable at the national level. They have laid the foundations for agreements on terrorism, economic policy, the media and language, amongst other things, in exchange for PP support for the investiture of the PSE-EE candidate. This pact has allowed Patxi López to spearhead political change in the Basque Country with a minority government supported by the PP.

The regional elections of 1 March were marked by the banning of Democrazia 3 Milloi (D3M), a platform of electors which was considered to be the political arm of ETA (see IEA newsletter # 10) This left up to 10% of the electorate without representation and opened the door to substantial changes in the composition of the Parliament. The electoral results did not give any party a sufficient majority to govern on its own. Of the coalitions that could have formed a governing majority, two emerged as the most likely. On the one hand that made up by the PNB (30 seats) and the PSE-EE (25 seats) and on the other that formed by the PSE-EE (25 seats) and the PP (13 seats). The first did not reach an agreement, despite having the most public backing according to the polls and having occurred in previous terms. The main reason for the lack of agreement was that both parties refused to negotiate on whether the President of the Government of the Basque Country would come from their party. The second signed the pact that has made Patxi López into the President of the Government of the Basque Country.

Permanent Seminar on the Evolution of Self-Government in Spain

 

The final document for 2008 is now available at the IEA web page (in Spanish), on the permanent seminar the Institute is conducting on the evolution of decentralization in Spain . Its purpose, like that of the preceding documents, is to monitor the main fields of interest on the suibject, and to identify the issues arising therein, their causes and the means of possible solution. The purpose of that research is both to allow the Institute itself to perform precise monitoring of the evolution the main features of decentralization, and to provide to the public the result of that research. You may consult the different chapters of the document, that concerns the decisions of the Constitutional Court , the regulatory activity of Central government, intergovernmental co-operation, the grant activity of Central government, the activity of the EU which has an impact upon self-government, and the financing system of the Autonomous Communities. Governments of the Autonomous Communities: data on the structure of the governments from the first elections
to present day

 

The IEA has prepared some tables that record the composition of the governments in each Autonomous Community from the first elections to the present day. In addition to the basic data on the composition of the governments, information has also been added on governmental stability, recording successful votes of no confidence and motions of confidence, and the total number of Presidents per legislature. The data has been obtained from the information and documentation services of the diverse regional parliaments. The document is also available on the IEA site.

Ruling 55/2009, of 9 March 2009

Deferred question of unconstitutionality 5810-2001. Raised by the Contentious - Administrative Court of the High Courts of Justice of the Balearic Isles with regard to article 11 of the Act of the Autonomous Community of the Balearic Isles 9/1997, of 22 December, on tax and administrative measures.

Finding: To partially admit the question of unconstitutionality and, by virtue thereof, to declare unconstitutional and null section 4 of article 11 of Act 9/1997, of 22 December, on tax and administrative measures of the Autonomous Community of the Balearic Isles and to reject the question of unconstitutionality in all the other points.

Ruling 86/2009, of 23 February 2009

Question of unconstitutionality 8484-2008. Raised by the Contentious - Administrative Court of the High Courts of Justice of the Canary Isles with regard to article 82.2 of the Act of the Parliament of the Canary Isles 2/1987, of 30 March, on the public function in the Canary Isles.

Finding: To admit this question of unconstitutionality and, by virtue thereof, to declare unconstitutional and null the paragraph "in no case shall the wage of the civil servants belonging to the corps or scales of group E be lower than the minimum interprofessional salary" of article 82.2 a ) of the Act by the Parliament of the Canary Isles 2/1987, of 30 March, on the public function in the Canary Isles.

Question of unconstitutionality 2900-2000. Raised by Contentious - Administrative Court number 3 of Las Palmas de Gran Canaria with regard to transitory provision one, section 3, of the Act by the Parliament of the Canary Isles 2/1999, of 4 February, on urgent measures for financial year 1999.

Government of Catalonia

 
 

The Plenary Meeting of the Constitutional Court, by provision of 3 March of this month, will admit proceedings on the positive conflict of competence number 1343-2009, filed by the Government of Catalonia in relation to Order ARM/2876/2008, of 2 October, that establishes the regulation bases to grant subventions to associations declared of public utility and foundations assigned to the protectorate of the Ministry for performance of activities related to programmes conducted to ensure defence of the environment and biodiversity, the sustainable use of natural resources and prevention of pollution and climate change, and Order ARM/3020/2008, of 22 October, that calls the award of those subventions, and according to the terms set forth in article 10.2 LOTC as drafted in Organic Act 6/2007, of 24 May, to attribute it to Court Two, that is due to hear this dispute, as it has become objective.

The Plenary Meeting of the Constitutional Court, by provision of 28 April this year, will admit the positive conflict of competence number 3090-2009, promoted by the Government of Catalonia against article 3, sections 3 and 4; additional provision six and addendum V of Royal Decree 1834/2008, of 8 November, that defines the training conditions to work as a teacher in mandatory secondary education, baccalaureate, vocational training and special regime teaching, and it establishes the specialities of the secondary education teaching corps.

Award of the 2nd Josep Maria Vilaseca i Marcet Prize

 

The award ceremony of the 2nd Josep Maria Vilaseca i Marcet Prize and presentation of the winning works will take place take place on the 8 th of July, at 12 00 , at the IEA headquarters.

The prize has been awarded ex-aequo to the works:

"Infraestructures aeroportuàries, federalisme i autonomia política: un estudi comparat dels reptes de la gestió dels aeroports a Espanya i Alemanya" (Airport infrastructures, federalism and political autonomy: a comparative study of the challenges of managing airports in Spain and Germany ), by Mercè Darnaculleta Gardella, Professor of Administrative Law at the University of Konstanz, Germany.

"La reforma constitucional del federalismo alemán" (Constitutional reform of German Federalism), by Antonio Arroyo Gil, Lawyer at the Democracy and Local Government Foundation.

 
 

 

 

Presentation of the collection "Clàssics del Federalisme" (Classics of Federalism)

 

Presentation of the collection "Clàssics del Federalisme" is soon to be held at the IEA headquarters. The idea of the collection is first time translation to Catalan of historically fundamental works on Federalism, that will be accompanied by studies of each work and its author prepared by leading specialists in the subject. Within the collection there will also be collective works with contributions from contemporary authors, allowing the study of the problems an prospects of federalism or, specifically, contemporary forms of federalism. With this double focus, IEA wishes to cover an existing shortfall in the spheres of legal and political sciences literature in Catalan, while offering to the specialised reader works that, until now, were only available in their original language, or in Spanish translations that are often already out of print. At the same time, the secondary aim is to promote the preparation and spread of Catalan-language studies of contemporary types of federalism.

Call for Grants 2009

The Commission to award grants to research the territorial policies of the Autonomous Communities, called by the Order by the Councillor for Internal Affairs, Institutional Relations and Participation, IRP/558/2008, on 22 December (DOGC number. 5290, on 5 January 2009 ), met on 6 April 2009 and made the following award proposals:

A) In the mode of overseas grants:

To Doctor Jordi Calvet Crespo, Professor of Political Science at the University of Barcelona, to perform research work into "The models of regional democracy: the Spanish and Italian cases", at the Università degli Studi de Siena , for 6 months, amounting to 10,200 euros gross.

To Doctor Maria del Mar Campins Eritja, Incumbent Professor of Public International Law at the University of Barcelona, to perform research work on "Reinforcement of

complimentary mechanisms and observance of multilateral environmental treaties within the framework of regional integration structures: a compared focus", at the University of Montreal , for 8 months, with an amount of 13,600 euros gross.

To Doctor Laura Chaqués Bonafont, Incumbent Professor of Political Science at the University of Barcelona, to perform research work on "Political decentralisation and agenda dynamics in Spain, 1978-2008", at Washington University, for 2 months, with an amount of 3,400 euros gross.

To Mr Ricardo Gracia Retortillo, Professor of Administrative Law at the University of Barcelona , to perform research work on "The supramunicipal level of local government in Germany ", at the University of Konstanz , for 6 six months, with an amount of 10,200 euros gross.

To Doctor Eva Pons Parera, Incumbent Professor of Constitutional Law at the University of Barcelona, to perform research work on "Recognition of plurilingualism in the central institutions of the State: the cases of Belgium and Finland " at the University of Helsinki and the Catholic University of Louvain, for 3 months, with an amount of 5,100 euros gross.

To Doctor Anna M. Palau Roque, Assistant Professor of Political Science at the University of Barcelona, to perform research work on "Comparative study of the dynamics of the regional and state agenda in Spain (1978-2008)", at the University of Washington, for 2 months, with an amount of 3,400 euros gross.

B) In the mode of grants to perform individual work in Catalonia or the rest of the Country

To Doctor Lucia Casado Casado, Professor of Administrative Law at the Rovira i Virgili University, to perform research work on "Forcible expropriation and the Autonomous Regions", for 14 months, with an amount of 5,000 euros gross.

To Doctor Carolina Gala Durán, Incumbent Professor of Labour and Social Security Law at the Autonomous University of Barcelona, to perform research work on "Regional development of gender equality policies", for 12 months, with an amount of 5,230 euros gross.

To Doctor Cristina de Gispert Brosa, Incumbent Professor of Applied Economics at the University of Barcelona, to perform research work on "Application of Evolving Data Analysis in formation of a wellbeing index of the Autonomous Communities", for 12 months, with an amount of 6,000 euros gross.

To Ms Míriam Hortas Rico, Professor of Applied Economics at the Complutense University of Madrid, to perform research work on "Urban dispersion and local public finance: dynamic analysis with panel data", for 10 months, with an amount of 1,670 euros gross.

C) In the team grant mode

To the team directed by Doctor Antonia Agulló Agüero, Professor of Financial and Tax Law at the Pompeu Fabra University , to perform research work on "The new regional tax administrations", for 24 months, with an amount of 38,500 euros gross.

D) In the mode of visiting professor grants

To Doctor Robert Agranoff, of Indiana University Bloomington, to perform research work on "Europeanization and IGR in Spain : is there a differential effect of EU or IGR in Europeanized and non-Europeanized sectors?" at the Autonomous University of Barcelona, for 2 months, with an amount of 3,000 euros gross.

To Doctor Guy Laforest, of the Laval University , to perform research work on "The meaning of Canadian federalism in Québec: critical reflections" at the Pompeu Fabra University , for 4 months, with an amount of 5,500 euros gross.

To Doctor Ornella Porchia, at the University of Torí , to perform research work on "Coordination measures and mechanisms adopted by Italy and Spain to handle the pre-litigation phase of EC regional infringement" at the University of Barcelona , for 4 months, with an amount of 5,000 euros gross.

To Doctor Leonzio Giuseppe Rizzo, at the University of Ferrara, to perform research work on "Federal transfers and politics: the case of Italy and Spain" at the Institute of Economics of Barcelona, University of Barcelona, for 6 months, with an amount of 9,000 euros gross.

E) In the mode of grants for collaboration with the IEA

To Ms Irene Gómez Alemany, student of Law and Economics at the Pompeu Fabra University , for a collaboration internship at the IEA, for 9 months, with an amount of 7,200 euros gross.

To Ms Anna Pons Vilaseca, graduate in Political Sciences and Administration at the Pompeu Fabra University, for a collaboration internship at the IEA for 5 months, with an amount of 4,000 euros gross.

To Mr David Martí Tomàs, student of Political Sciences and Administration at the Pompeu Fabra University , for a collaboration internship at the IEA for 5 months, with an amount of 4,000 euros gross.

To Mr Pau Bossacoma Busquets, student of Law and Political Sciences and Administration at the Pompeu Fabra University , for a collaboration internship at the IEA for 9 months, with an amount of 7,200 euros gross.

Just as foreseen in point 15 of addendum 5 of the calling schedule, the board resolved to name the following substitutes, in the event of any of the above grantees renouncing, in the order indicated below:

The Autonomous Communities and articulation of the principle of subsidiarity, 17 June

The Treaty of Lisbon aims to encourage effective application of the principle of subsidiarity, a fact that, among other things, opens up new possibilities of acting for parliaments and brings application of that principle back into the spotlight. That means it is of interest to examine, faced with the perspective of future enforcement of the Treatment, what the role of the principle of subsidiarity might be in it, what the channels would be to make it effective and, especially, how the Autonomous Communities might contribute to safeguard its application.

The speakers will be Pedro Cervilla Martínez, Assistant Director of Administration and Finances of the Regions Committee; Eduard Roig Molés, Professor of Constitutional Law at the University of Barcelona, and advisor to the Presidency Cabinet of the Government of Spain; Marta Sobrido Prieto, Professor of International Law at the University of La Coruña; Laura Huici Sancho, Professor of International Public Law at the University of Barcelona; and Susana Beltrán García, Professor of International Public Law at the Autonomous University of Barcelona. The final address at the seminar will be given by Professor Andreu Olesti Rayo, of the Chair of Public International Law at the University of Barcelona.

Seminar Programme

The increase in competences in the European Union and the consequences on the competences of the Autonomous Communities, 14 September

The seminar will cover the subject from diverse approaches. Thus, development of the internal market and liberalisation of services will be analysed; with increased security, liberty and justice competences in the EU; consumer protection; research and multi-level protection of fundamental rights.

The speakers will be: Professor Luis Miguel Hinojosa Martínez, of the Chair of Public International Law at the University of Granada; Javier Donaire Villa, Incumbent Professor of Constitutional Law at the Carlos III University; Enriqueta Expósito Gómez, Incumbent Professor of Constitutional Law at the University of Barcelona; David Moya Malapeira, Professor of Constitutional Law at the University of Barcelona and Aida Torres Pérez, Professor of Constitutional Law at the Pompeu Fabra University. The closing address will be given by Professor Andreu Olesti Rayo, of the Chair of Public International Law at the University of Barcelona.

Plurilingualism in the Spanish Constitution, 18 March

The seminar concerned the constitutional regulation of multilingualism and will concentrate on analysis of whether, after thirty years have elapsed from the Spanish Constitution coming into force, the regulations have yet fulfilled the objectives of effectively protecting the plurilingual phenomenon and recognising citizens the linguistic rights that are to make it possible.

The speakers were Giovanni Poggeschi, researcher at the Institute for Studies on Federalism and Regionalism of the European Academy of Bolzano; Xabier Arzoz Santisteban, Professor of Administrative Law at the University of the Basque Country; Jaume Vernet i Llobet, Professor of Constitutional Law at the Rovira i Virgili University and Advisor to the Consultant Council to the Government of Catalonia; Joan Ramon Solé Durany, responsible for Linguistic Legislation at the Secretariat for Linguistic Policy of the Government of Catalonia; and Antoni Milian i Massana, Professor of Administrative Law at the Autonomous University of Barcelona.

     
 

Right to housing and public services, 17 April

The seminar concentrated on analysis of the right to housing recognised in chapter three of title one of the Constitution in which the powers that be have little to show in the prevailing conditions of constant rises in housing prices, having acted by building subsidised housing and with an underlying system of devolution in which, while all the competence is, in principle, exclusively the remit of the Autonomous Communities, the Central Government has found diverse channels through which to act. The seminar, based on study of the competence distribution system in the United States, as a relevant overseas example, and in Spain, analysed some key matters concerning intervention in housing matters in the regional field.

The speakers were Patrícia Salkin, Professor of Law and Director of the Government Law Center of Albany Law School; Gerardo Ruiz Rico, Professor of Constitutional Law at the University of Jaén; Domènec Sibina, Incumbent Professor of Administrative Law at the University of Barcelona, i Juli Ponce, Incumbent Professor of Administrative Law at the University of Barcelona.

The Revista d'Estudis Autonòmics i Federals has received a positive appraisal and has thus been included in the journal indexing system DICE.
