Ruling 168/2009, of 9 July 2009

Unconstitutionality appeal no. 247-2003, filed by the President of the Government in relation to the second additional provision an the appendix I of the Act by the Basque Parliament 5/2002, of 4 October, as second modification of the Act governing the general road plan of Basque Country.

Finding: admit the appeal and, by virtue thereof, to declare unconstitutional and null the contested sections.

Ruling 137/2009, of 15 June 2009

Deferred questions of unconstitutionality 1236-2001 and 430-2002 (accumulated). Raised by the Contentious-Administrative Court of the High Courts of Justice of the Canary Islands with regard to the transitory provision thirty-four, section one, of the Act by the Parliament of the Canary Islands 2/1999, of 4 February, on urgent measures for financial year 1999.

Finding: To reject this question of unconstitutionality.

Raised by the Contentious-Administrative Court of the High Courts of Justice of Navarra with regard to the first additional provision, section one, of the Foral Act 11/2004, of 29 October, that updates the local regime of Navarra.

Finding: admit the question of unconstitutionality and, by virtue thereof, to declare unconstitutional and null the autonomous articles.

Deferred question of unconstitutionality 5891-2005. Raised by the Contentious-Administrative no. 2 of Santander with regard to the article 31 c) of the Act of Cantabria 1/2002, of 26 February, on trade.

Finding: admit the question of unconstitutionality and, by virtue thereof, to declare unconstitutional and null the second section of the letter c) of the article 31 of the Act 1/2002, of 26 February, on trade of Cantabria.

Ruling 138/2009, of 15 June 2009

Conflict of competence number 476-2003. Filed by the Government of Andalusia in relation to the Order of the Environment Ministry that establishes the governing bass of the research aids on subjects related to the national parks' net that are announced for 2002. The Constitutional Court declares competent the Autonomous Community.

Ruling 136/2009, of 15 June 2009

Conflict of competence number 368-2001. Filed by the Government of Aragon in relation to the ruling of the Directorate of the Diversification and Energy Saving Institute that regulates the aids to support the thermal solar energy. The Constitutional Court declares competent the Autonomous Community.
